This Notice of Financial Incentive is provided pursuant to the California Consumer Privacy Act (CCPA), California Civil Code Section 1798.125. It describes the loyalty rewards program offered by Phoenician Garden Mediterranean Bar and Grill and explains the material terms of the financial incentive we provide to program participants.

What the Program Is
Phoenician Garden Mediterranean Bar and Grill participates in a loyalty rewards program powered by SpotOn. Through this program, customers can earn rewards on qualifying purchases and receive promotional offers. The program is designed to reward our returning guests and provide them with additional value when they dine with us or place orders for pickup and delivery.
About the SpotOn platform. SpotOn is the technology provider that operates this loyalty program on our behalf. Under SpotOn's Merchant Terms and Consumer Privacy Policy, SpotOn has its own rights to use, retain, aggregate, and share data generated through the program. SpotOn may also use information about enrolled customers to contact them or to allow others to do so. SpotOn's handling of your information is governed by SpotOn's own privacy policy, which you should review before enrolling. Phoenician Garden's own use of loyalty data is restricted to marketing our food and services to you during your relationship with us; we do not sell loyalty data, and we do not use it to make decisions that change the price or quality of food and service you receive.
Personal Information We Collect
When you enroll in our loyalty rewards program, the program collects the following categories of personal information:
- Name
- Email address
- Phone number
- Purchase history
- Transaction data (items ordered, dates, amounts, and location)
This information is collected on our behalf by SpotOn and shared with us so we can administer your account, track your rewards balance, send you promotional offers, and improve your overall experience at Phoenician Garden. Additional usage and performance data (for example, how you interact with the SpotOn platform) is collected and held by SpotOn under SpotOn's own terms; SpotOn shares de-identified and aggregated reporting with us. SpotOn may share data with its third-party service providers and partners as described in SpotOn's Consumer Privacy Policy.
What You Receive
As a participant in our loyalty rewards program, you may receive the following benefits:
- Loyalty rewards earned on qualifying purchases
- Points that can be redeemed toward future purchases
- Promotional offers and discounts
- Exclusive deals available only to program members
How to Opt In
Participation in the loyalty rewards program is entirely voluntary. Customers opt in to the program when they sign up at the restaurant or through the SpotOn platform. You will not be enrolled automatically. By signing up, you agree to the terms of the program and consent to the collection of the personal information described above for the purpose of administering your rewards.
How to Opt Out and Right to Withdraw
You may opt out of the loyalty rewards program at any time and for any reason, without penalty or loss of access to our regular menu, pricing, or services. To opt out of the Phoenician Garden side of the program, you can:
Because SpotOn operates the program and holds enrollment data under its own terms, you should also visit SpotOn's Consumer Privacy Policy to opt out of any communications or data uses that SpotOn controls separately from us. Opting out of one side does not automatically opt you out of the other; we recommend doing both if you want to fully withdraw.
Upon opting out, any unused rewards or points in your account may be forfeited, but you will continue to receive the same quality of food and service as all other customers. Your right to withdraw from the program is unconditional and can be exercised at any time.
Good-Faith Value Estimate
Under the CCPA, we are required to provide a good-faith estimate of the value of the consumer data collected through our loyalty program. We estimate that the value of the financial incentive provided to loyalty program members is reasonably related to the value of the personal information you provide to us. This estimate is based on the expense we incur in collecting and retaining that information, as well as the revenue generated from the loyalty program as a whole.
We calculated this estimate by considering: (a) SpotOn platform fees and the technology and operations costs of administering the loyalty program; (b) the cost of the rewards, points, and discounts provided to members; (c) the value to us of being able to contact returning customers with relevant offers; and (d) the overall revenue attributable to loyalty program participation. Because SpotOn also retains and processes loyalty data under its own terms, a portion of the platform value flows to SpotOn; we do not receive a direct payment from SpotOn for your enrollment.
Materially Equal Terms
The price and quality of goods and services offered to loyalty program members and non-members are materially the same. Loyalty program benefits, including rewards, points, and promotional offers, are additional incentives provided to program participants. They are not conditions of service, and opting out of the program will not result in any difference in the price you pay or the quality of food and service you receive at Phoenician Garden.
